Hayes v. Napolitano, D.D.C. No. 12-825 (ABJ) (2012)
Of course, the most significant gender discrimination case our firm has handled is Hayes v. Napolitano, a 2012 matter that made national headlines. We represented ICE Chief James Hayes after he was passed over for promotions in favor of less-qualified individuals connected to then-Governor Napolitano.
When Mr. Hayes complained about discrimination and corruption, ICE officials launched six unfounded investigations against him. The case garnered coverage on NBC’s Today Show, Fox News, CNN, The Wall Street Journal, The New York Times, Chicago Tribune, Los Angeles Times, and The Washington Post.
After months in federal court, the Chief of Staff resigned and Mr. Hayes received a $175,000 settlement without losing his job. We overcame the government’s motion to dismiss by securing key affidavits from courageous ICE employees, and our strategic media engagement turned coverage in our favor—demonstrating the power of comprehensive case strategy.

What is employment discrimination?
Employment discrimination occurs when an employer treats an employee or applicant unfavorably because of a protected characteristic—such as race, gender, age, disability, or religion—violating laws like Title VII, the ADEA, or the ADA.
Which characteristics are protected?
Federal law protects race, color, religion, sex (including pregnancy, gender identity, and sexual orientation), national origin, age (40+), disability, and genetic information. Federal employees also have MSPB appeal rights against discriminatory actions.
How and when do I file a claim?
Private‐sector and mixed‐motive claims must start with an EEOC charge—generally within 180 days (sometimes 300 days) of the discriminatory act. Federal employees file EEO complaints with the agency, then MSPB appeals within 30 days of an adverse agency decision.
What remedies are available?
